As part of this commitment, Index has multiple policy and regulatory mechanisms in place that make us a trusted partner and industry leader. These mechanisms include a dedicated team of experts that review advertisements before and after activation on the exchange, a core regulatory and legal team that monitors legal governance and sets policies that assure confidence in our review practices, and certification from industry trade bodies that affirm our robust compliance practices. Privacy regulation and data protection laws

Index adheres to the requirements of global privacy regulations. Please note that the table below lists the main privacy and data protection laws that Index supports by region; this list is not exhaustive.

ePrivacy

The ePrivacy Directive is a legal instrument focused on the confidentiality of electronic communications related to tracking and monitoring, such as with cookies and other digital trackers.

The General Data Protection Regulation (GDPR), (European Union)

The GDPR is an European Union (EU) data privacy regulation that protects the personal data of all EU residents. The regulation establishes rights for individuals and rules for businesses handling the personal data of EU residents (including companies established outside the EU). Quebec’s Law 25 (Canada)

Index meets the requirements of Quebec’s Law 25 and is a registered TCF Vendor under IAB Interactive Advertising Bureau (IAB). An advertising business organization that develops industry standards, conducts research, and provides legal support for the online advertising industry. Canada’s Transparency & Consent Framework Canada (TCF Canada).

Data Privacy Framework (DPF) Program

Index supports the Data Privacy Framework Program, which provides mechanisms for personal data transfers to the United States from the European Union, United Kingdom, and Switzerland and ensures that data protection that is consistent with EU, UK, and Swiss law.

Index meets the requirements of state-level privacy regulations, including but not limited to:

  • California, California Consumer Privacy Act of 2018 (CCPA), including any amendment such as the California Privacy Rights Act of 2020 (CPRA)

  • Colorado, Colorado Privacy Act (CPA)

  • Connecticut, Connecticut’s Act Concerning Personal Data Privacy and Online Monitoring (CTDPA)

  • Delaware, Delaware Personal Data Privacy Act (DPDPA)

  • Indiana, Consumer Data Protection Act (ICDPA)

  • Iowa, Iowa Consumer Data Protection Act (ICDPA)

Children’s Online Privacy Protection Act (COPPA), (United States)

Brazilian General Data Protection Act (in Portuguese, Lei Geral de Proteção de Dados, or, LGPD), (Brazil)

The LGPD is a legal framework that regulates the collection and use of personal data and applies to data processing that takes place in Brazil, for the purposes of offering goods and services or to process data, or people who are located in Brazil. Digital Services Act (DSA)

The DSA requires that users have real-time access to information about ads shown to them on an online platform, such as the identity of the advertiser.

Index is not directly captured by the DSA but we support publishers who are implementing IAB's DSA Solution, a technical specification to standardize the collection, compilation, and transport of data needed to meet the transparency requirements under the DSA.

JICDAQ is a certification mechanism that is designed to ensure quality in the digital advertising marketplace.

Index has been certified by JICDAQ following an audit of our standards for business processes related to ensuring brand safety and preventing advertising fraud.

Supply quality and partnerships

Supply partner review

Index is committed to maintaining a high quality and low-fraud exchange by choosing to work with select, premium supply partners. We require that all supply partners meet certain standards before they may be activated on the exchange, and have a specialized team in place to review supply partner inventory for compliance with these standards.

Supply fraud prevention

Index is committed to operating a transparent and clean exchange. To ensure we meet this goal, Index has partnered with industry-leading third party anti-fraud vendors. Index leverages these partnerships to scan each advertising opportunity received by our exchange to filter out ad requests originating from bots or fraudulent traffic.

Demand quality and partnerships

Demand review

Index is a leader in providing a transparent ecosystem for both advertisers and publishers. To deliver on our values and quality standards, we have a dedicated team of quality control experts who review the content and functionality of all ads before and after activation on the exchange. Compliance with industry standards

Index is committed to a digital advertising ecosystem that is high-quality, fair, efficient, and transparent. As part of these commitments, Index is dedicated to meeting the following standards below set by leading industry bodies:

  • Coalition for Better Ads (CBA): all advertisements adhere to the Coalition for Better Ads (CBA) standards for functional performance and ad unit size.
  • OpenRTB: Index adheres to OpenRTB communication standards during auctions. For more information about how Index supports OpenRTB, see Integrate with Index as a DSP using OpenRTB or Integrate with Index as a publisher using OpenRTB.
  • Interactive Advertising Bureau: Index adheres to IAB's advertising standards and best practices, including ad sizes, functionality, and quality standards.
  • IAB Tech Lab: Index contributes to the IAB tech lab with innovative thought leadership and solutions to industry problems.
  • Digital Advertising Alliance (DAA) Self-Regulatory Principles: Index requires that advertisers engaging in interest-based advertising include a ‘YourAdChoices’ notice.

Index’s standards are also informed by the Global Alliance for Responsible Media (“GARM”) Brand Safety Standards.

Demand fraud prevention

Index partners with third-party technology providers to help block fraud and malware on inventory from Index supply partners in real-time. This partnership is consistent with our commitment to providing a clean exchange for all of our supply and demand partners.
